In the daily life of public procurement we observe an increased willingness of unsuccessful bidders to challenge contract awards, due to

  • lack of predictability,
  • lack of transparency,
  • lack of verification

and

  • evaluation based on elements not defined in the requirements specification or award criteria.

 

A common cause is that the contracting authority is not sufficiently conscious of this connection when the specification is being prepared. Consequently, a violation however unintended of the regulations happens, resulting in a subsequent demand for access and/or a complaint.

Ensuring compliance with current regulations is the responsibility of the purchasing agent. However, discrepancies can be difficult to detect due to lack of knowledge within a certain field or an unwieldy number of requirements for larger and complex procurement processes.

To counteract the problem, I have developed an Excel/VBA based model for Requirements Specifications, Tender Evaluation and Award Criteria. This Excel/VBA based model has been developed to aid principal and purchaser in designing and organizing requirements and the subsequent tender evaluation.

All members of the interdisciplinary procurement team must have the same understanding of the connection between requirements, award criteria and the evaluation model.

Externally we may avoid that a complainant is successful in an action to cancel the award, by making sure that predictability, transparency and verification possibilities are ensured through the entire procurement process.

Openness must be shown towards the vendors regarding the connection between requirements, award criteria and evaluation model. This shall be clearly stated in the information to tender/RFP through

  • Standardized templates for requirements specifications and evaluation.
  • The evaluation methodology is described
  • Weighting of criteria is shown
  • Handling of options are clearly specified
  • Calculation methods are described (proportional or linear method).
